What bank should do when a deposited cheque drawn on overseas bank is found not genuine? Will they return ?

If a deposited cheque is found by the bank is not genuine what the bank will do? My question is 1. will they return the instrument to the depositor after defacing it? 2. Will they Keep the instrument with them and just say that it is not genuine?
What are the instructions given to the banker by the RBI in this regard and where it is mentioned in the guideline of RBI or any other competent authority?

Can i sell a home which is on home loan before 5 years which was claimed for tax deduction?

I have a seen a clause in the yearly bank statement that i will not be entitled for tax saving on home loan if flat is sold before 5 years. Is it true?
