Who do I contact legally about my 401K problems?

I was recently fired from my job and wish to transfer my 401K over to the company I’m now working for. The rep. I spoke with said I would not be able to do this because the company I use to work for still have me listed as active. I was told that until they remove me from their payroll I couldn’t do anything with my 401. The thing is I’ve been away from this company for nearly a month now and they still haven’t removed me from their payroll. Who do I need to call to make them get off their A$$ and do their job?

My husband is having problems with SSDI, they say he overpaid, we have money in 401k, can they take it?

Are these likely to be at risk or affected because of the current problems banks are having with sub-prime mortgages?

What are the problems with taking my pension early, at age 57, so I may raise my contribution to my 401k?
